HI. Lee Phillips here. I want to talk to you a minute about well, naming trustees, naming guardians,
those are in other YouTube videos naming the agent for the durable power of attorney Here’s the question though. Do we have to have the same guy be the trustee,
the executor/executrix actually they, we’re enligtened now,
we don’t call them executors/executrixs anymore we call them “personal representative” but the guy who takes care of the will the guy who takes care of the trust,
the guy who takes care of the will and the guy who’s your agent who takes care of you under the durable power of attorney Is that the same guy? No, not necessarily. We could have a different trustee he could be the brilliant or she can be the brilliant business person they could be the same in the executor executrix capacity but we could have somebody else be different for the agent It’s been a number of cases that I’ve had the guy who had decided on who the trustees and the personal representative, executor/executrix are going to be and then I say okay you want the same guy for the agent under the durable power of attorney? The guy who pulls the plug,
the guy who decides which rest home you’re going in and everything else And the guy looks at me and says, “Hell no.” “They’ll unplug me.” So we picked somebody else with a little more compassion who knows you a little better maybe for the agent for the durable power of attorney, the medical power of attorney, we have combined those in our office . Could be two separate documents. But they’re a different different person. Or, very often we have the same person be all three trustee, executor/executrix, or/and agent that’s a guy who acts on your behalf under the durable power of attorney when you can’t act anymore you’re still alive but you’re incompetent. and I know you may be close, but we’ll wait till you actually get there, all right?
